Building Open Patent Pool Model

11,400,000 yen [Grant Project]
Center for the Management of Intellectual Property in Health Research and Development (England)

This project will develop a trial business model for open patent pools and undertake the following activities aimed at sharing this knowledge with joint funding from SPF and the Rockefeller Foundation (US).
  1. Development/evaluation of a business model
    • An empirical analysis will be conducted on patents related to influenza, SARS, and malaria, such as information on patent holders, existence of blocking patents etc. The results of the empirical analysis will be further analyzed by teams of specialists and advisors as necessary.
    • The project will develop an effective business model for operating open patent pools, by identifying essential patents to be added to the patent pool, as well as examining royalty payment methods, licensing methods, pros and cons of establishing a third party institution/characteristics of the organization, and the possibility of infringement of the antimonopoly law. The business model will be further refined following feedback from the advisory team and industrial world.

    • Dissemination and publication of information
The open patent model developed through the abovementioned activities will be published in the MIHR handbook and academic journals, and also announced at an international conference(sponsored by another organization)in the US.
